Query: Restrictive Covenant

I am an associate in a practice and am looking to go out on my own. According to my employment contract, I can't open a practice within three miles for three years. Is this enforceable?

Local courts vary on this, so it's best to consult with a local healthcare attorney. Generally, a three mile limit will be enforced in a suburban or rural area, but not in an urban setting.
