OH Podiatrist Delivers Weekly Republican Address
Representative Dr. Brad Wenstrup (OH-R) was selected by House Speaker John Boehner (OH-R) to deliver the weekly Republican address on Saturday, Nov. 15. "We’ll take on ObamaCare... and we’ll propose that Congress – not the bureaucrats – has the final say on all new major regulations," said Wenstrup.

FL Podiatrist Attends Aesthetic Experts Summit in Istanbul
Asia met Europe at the world's masters Aesthetic Experts Summit in Istanbul, Turkey this weekend. Dr. Bret Ribotsky, a podiatric foot and ankle surgeon from Boca Ration, FL attended the conference sponsored by Merz Aesthetics. "It's fascinating to be able to learn from the greatest physicians in the world in the aesthetic space," said Ribotsky.

"Learning about rheology, the G prime and the G double prime, and watching the most accomplished injectors in the world placing special needles and cannulas into the face provided an incredible insight into the new products available and how they can be used in feet," said Ribotsky.

Retired MA Podiatrist Serves as Chairman of Veteran's Group
Local veterans with many years of service and many stories to tell congregated Nov. 10 to celebrate Veterans Day. Retired Billerica podiatrist Dr. Gordon Gibb serves as chairman of the Community Table, an organization of the First Parish Church in Billerica Center. Gibb said volunteers from the Community Table helped put together the veterans luncheon.

“Bob Kinsman (chairman of DAV Chapter 47) talked to me about coming up here, and we arranged with the Billerica Lions Club and some private donors from Billerica to fund us," Gibb said. "Each veteran will also get a gift bag with toothpaste, toothbrush, shavers, deodorant, cookies, flashlight, and other necessities.” For 17 years, Gibb's group has served dinner to 60 people one Saturday a month at the church.

Bret Ribotsky: Should podiatrists use physician extenders?

Harry Goldsmith: Absolutely. In order to economically grow practices, physician extenders sometimes are a must. Typically, podiatric practices rely on medical assistants. The extent of the services they can render is limited by state regulation. More and more DPMs are looking at the possibility of hiring physician assistants (PAs) only to find that many states do not permit “limited licensed” podiatrists to supervise physician assistants. Alternatively, some podiatrists have turned to hiring RNs and nurse practitioners who would function as employees within the license limitations of the podiatrist, performing services “incident to” those of the podiatrist in managing patients.
I feel that if a podiatric practice needed a highly trained physician extender, there is no need to look beyond the pool of “not busy”, semi-retired, or even retired but still licensed podiatrists in the community who are willing and happy to see patients either “incident to” or as employees. The burdens of maintaining a solo practice is wearing on many doctors. This arrangement to join in some fashion another practitioner’s practice and not be an owner may be just what they are looking for. A win-win.

Court Allows HIPAA Negligence Claim
A Connecticut Supreme Court has ruled that plaintiffs can sue for negligence if a healthcare provider violates HIPAA regulations for protecting patient privacy. The Connecticut case of Emily Byrne vs. Avery Center for Obstetrics and Gynecology involved a patient who sued a healthcare clinic that released her medical records to a third party without her authorization. But legal experts say the ruling could potentially have relevance in certain data breach cases.
"HIPAA does not provide for the 'private right of action,' or [the right of] private folks to sue under the statute," says privacy attorney Brad Rostolsky of the law firm Reed Smith. "Enforcement actions and fines for HIPAA violations are levied by federal regulators. But in a handful of cases, like this Connecticut ruling, courts have allowed HIPAA as the 'standard of care' for negligence claims."

Six Ways to Avoid a RAC Audit - Part 1
Small- and medium-sized practices are not below the RAC radar and should heed the following succinct steps to avoid and/or minimize exposure.
1. Avoid copy-and-paste documentation — While it is acceptable to use templates, your documentation must be patient-specific. The RACs have been chastised by the Office of Inspector General (OIG) for not giving this issue enough attention; expect greater scrutiny in 2015 and beyond. Boiler plate wording may be your starting point, but it only passes muster when made patient-specific.
2. Know where you stand on E&M coding — Physicians who over-code evaluation and management services (E&M) relative to their peers remain at a greater risk of audit. Compare your E&M coding averages to a national benchmark. The American Association of Professional Coders (AAPC) offers an easy and free way to get national E&M coding averages by specialty.

Query: Repair Conundrum
The tube head on our x-ray machine was not holding position well. The counterbalance spring was worn and already maximally tightened. We called a local x-ray repair business and explained this to them. They insisted on sending someone the 25 miles to our office to inspect the machine before ordering another spring. Upon arriving, they immediately confirmed the spring was worn and took the model and serial number of the unit to order another.
We received a call several days later informing us the model was no longer in production and parts were unavailable. The following week we received a service invoice for $318. 1 hr. travel time and 1 hr. "labor", both at $150/hr, plus state sales tax. Would you pay the invoice as received?

If you are looking for a great unit to treat muscloskeletal problems, I would look into Dynatronics Solaris with light therapy. In addition to laser, it will do interferential direct current, Russian stim, high voltage galvanic, etc. You can also buy a model that does therapeutic ultrasound as well. If you buy it from a good distributor, the rep will generally come to your office and teach you all there is to know about the unit. I paid a little over 4K for mine.
